Cette Constitution est fondée sur une séparation stricte des pouvoirs, établissant ainsi un régime présidentiel. Le pouvoir exécutif est du ressort d'un président, à la fois chef de l'État et chef du gouvernement. Le pouvoir législatif est bicaméral. Il s'agit du Congrès, composé de deux chambres législatives : d'une part la Chambre des représentants (chambre basse), qui représente les citoyens, et d'autre part le Sénat (chambre haute), qui représente les États fédérés. Seules ces chambres possèdent l'initiative parlementaire et votent les lois, ainsi que le budget fédéral. Enfin, le pouvoir judiciaire présente à son sommet la Cour suprême, qui veille au respect de la Constitution par les lois, les États fédérés et les organes de l'État fédéral.
