RESUME
Le 4 mai 2011, 5 mois après une première décision du 3 décembre 2010 proclamant vainqueur de l’élection présidentielle du 28 novembre 2010 le président Laurent Gbagbo, le
Conseil constitutionnel ivoirien devait se dédire par une nouvelle décision. Cette décision, pour revêtir un caractère utilitaire, ne marque pas moins l’attachement du Conseil constitutionnel à la légalité constitutionnelle. C’est ce qu’entend faire observer principalement cette étude. D’abord, à travers la démonstration du caractère inédit de la décision du 4 mai
2011, tant au regard de sa forme que du fond ; ensuite, en mettant en avant, d’une part, la régularisation, a posteriori, qu’elle fait des actes pris par le Président Ouattara, alors même qu’il n’avait encore reçu aucune investiture, et d’autre part, la recommandation qui lui est faite de prêter serment, conformément à la constitution ivoirienne.

ABSTRACT
On May 4, 2011, five months after the first decision proclaiming Laurent Gbagbo winner of the November 28, 2010 run-off election, the Constitutional Council was to retract and give a new decision. That decision, even though, it obeys to a utilitarian objective does not however deny the attachment of the Constitutional Council to the constitutional legality.
This is the main objective of this study. First, it demonstrates, both on the form and the content, the unprecedented nature of the May 4, 2010 decision. Then, it highlights, on the one hand, the regularization, a posteriori, of the decisions taken by the president
