Abstract
While terminal operators have become an essential link to the international transport chain, international legislations have yet to recognize and define the importance of this activity. In most cases, operators are limited to incompatible and restrictive national legislations. In France, the terminal exploitation in harbour areas is constrained by the application and notion of public services. European Union legislations have permitted great improvements for terminal operators, nevertheless, the activity remains characterized by a lack of flexibility as well as a lack of judicial security. Although operators around the world offer identical services, the notion of a common liability is non-existent. The Vienna Convention on the responsibility of transport exploiters, attempted to harmonize this responsibility on an international level which was then rejected by the international community. So far the existing texts only offer fragmented answers, borrowed from the judicial regimes of different transport actors. Clarification of terminal operator’s legal status is wished.

L’opérateur de terminal est devenu un maillon essentiel de la chaîne de transport international. Pourtant, aucun texte international ne reconnaît clairement son activité. Ne bénéficiant ni de définition légale, ni d’un statut propre, les opérateurs sont soumis à des législations nationales souvent mal adaptées et contraignantes.

En France, l’exploitation de terminal, implantée sur en zone portuaire, est soumise à un ensemble de contraintes dont la plupart sont liées à l’application du régime de la domanialité publique, encore trop largement rattaché à la notion de service public. La législation
