ABSTRACT
Boundary disputes have harmed security, stability and prosperity in Latin America for nearly two hundred years. Actually, Chile and Peru maintain an official controversy about their maritime boundary delimitation; Chile claims a boundary along the geographical parallel that passes by the point on which the land border between both countries reaches the sea, while Peru argues that no maritime boundary has ever been agreed.
The focus of this dissertation is the official position of both countries detailed in public documents, the analysis of the international documents signed by Chile and Peru, the relationships between the rules of international law applicable to the delimitation of the maritime boundaries, state practice and jurisprudence, the evaluation of the considerations for settling the maritime boundary between Chile and Peru, and a proposal of actions for the solution.
The premise behind this dissertation is that policymakers in Chile and Peru must be more inclined to take steps to solve this old controversy, and prevent the tensions and the outbreak of violent conflict.
