In fact Spain has joined January 2 the list of European countries that have banned smoking not only enclosed public spaces, but also cafes and restaurants. The situation in Spain is more complicated
Banning smoking in Spain.
Several countries in Europe have brought in strict laws to combat smoking in public places, with many banning it completely. However, the situation in Spain is more complicate. the new law in effect since Jan. 2 in the country is one of the strictest in Europe. It prohibits smoking in all enclosed public places like bars and restaurants but also in the play areas for children and to outdoor areas in front of schools or hospitals.
On the other side institutions do not even have the right to build smoking areas, as is the case in France where we see in pubs, cafes and restaurans smoking rooms . Cases of violations, fines can range from 30 000-600 000 euros.

The anti-smoking rules introduced in 2006 outlawed smoking in the workplace, notably to airports railways stations and ports.
Completely in hospitals, sport covered and malls.
And Partially in bars, hotel, restaurants where bars and restaurants owner choose whether or not to allow smoking. Most chose not to impose any ban. Thus the country was an exception.
Only large restaurants and bars were obliged to provide a smoke-free area.
On the other side with this new law, restaurant professionals fear a decline of 5 to 10% of their turnover, also some 350 000 jobs would be threatened according to the Spanish Federation of Hospitality (FEHR). But doctors argue the new legislation will help smokers
