“The words Know Your Customer in the financial sense describe the process by which a bank or financial institution checks the identity, background and other aspects of the source of wealth of potential and existing customers. Also known as KYC, legislation and regulation require firms to obtain evidence of identity of a customer at take-on and to keep a record of that evidence for as long as there is a relationship with a customer. Legislation and regulation also require a firm to keep up to date its knowledge of a customer throughout the life of the relationship, so that changes in the customer's activity can be assessed and dealt with – all with the principal aim of preventing Money Laundering and Financial Crime.”
Le KYC vise avant tout à lutter contre le blanchiment de capitaux et le financement du terrorisme, par une bonne connaissance du client reposant sur des recherches appropriées.
Les recherches menées sur le client sont d’autant plus approfondies lorsqu’il existe un faisceau d’indices : c’est la notion de « enhanced due diligence »
Des lois existent en effet déjà sur ce sujet dans plusieurs pays (Afrique du Sud et Etats-Unis (2001) / Inde (2002) / Nouvelle Zélande (2009).
La directive européenne de 2005, relatives à lutte contre le blanchiment ou au traitement des PPE a été tardivement transposée en droit français (01/2009) et sa transposition est contestée par les instances internationales qui la jugent imparfaite.
Les principales dimensions sont :
- des obligations de déclaration (Tracfin)
- des obligations de vigilance (simple ou renforcée)
- les échanges d’informations entre pays « équivalents
