Bearing arms in the USA = an inalienable right
The right to bear arms is part of the constitution (Second Amendment) and goes back to pioneering times, when men had to fight in order to defend their freedom and property.
2nd Amendment to the Constitution
Il garantit pour tout citoyen américain le droit de porter des armes. Il fait partie des dix amendements passés le 15 décembre 1791, couramment appelés « Déclaration des Droits » (Bill of Rights).
“A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed”.

La codification du droit de porter des armes dans le Bill of Rights fut influencée par la peur que le gouvernement fédéral pourrait désarmer le peuple afin d’imposer des règles par l’intermédiaire d’une armée de métier ou d’une milice, puisque l’histoire avait montré la façon dont les tyrans éliminaient la résistance en retirant les armes au peuple et en rendant illégal le fait d’en conserver afin de supprimer les opposants politiques. Dans District of Columbia v. Heller (26 juin 2008), la Cour suprême ordonna que l’autodéfense est un élément central du droit.
