France : retrieving parliamentary control (after the constitutional reform of 2008)
The 2008 constitutional reform in France has not made the problem of the constitutional status of the executive’s parliamentary control any clearer, and neither has the case law of the Constitutional Council. Both only stand as evidences of the limits of a merely juridical approach to the constitution. Only by bringing in such concepts as political representation and political accountability is it possible to shed some light on the matter of parliamentary control over the executive power.

Wie kann man die parlamentarische Kontrolle der Exekutive verfassungstheoretisch erdenken ? Die französische Verfassungsreform von 2008-2009 sowie die jüngste Rechtsprechung haben diese Frage nicht geklärt. Dies offenbart die Grenzen eines rein juristischen und statischen Verständnisses der Verfassung, das die politische und dynamische Dimension der parlamentarischen Kontrolle ausblendet. Letztere liegt im Schnittpunkt von Repräsentation und Verantwortlichkeit, die ja nicht nur durch streng juristische Kriterien erfasst werden können, sondern in erster Linie durch die Wechselbeziehungen
